A federal court has given Texas a temporary victory in its lawsuit against the Biden government’s coronavirus vaccine mandate, which suspends the controversial Texas federal government ordinance.
“Yesterday I sued the Biden admin for his illegal OSHA Vax mandate,” Texas Republican Attorney General Ken Paxton tweeted on Saturday. “WE WON. Just this morning, the 5th District retained its mandate, citing” serious legal and constitutional problems “. The fight is not over yet and I will never stop resisting this admin’s unconstitutional excess!”

Earlier this week, Paxton sued the Biden government over the mandate, arguing that the move to force workers in companies with more than 100 employees to get vaccinated or to undergo weekly tests was “thoroughly unconstitutional.”
“Biden’s new vaccination mandate for private companies is a breathtaking abuse of power,” Paxton tweeted on Friday. “OSHA has limited powers and specific responsibilities. This latest step goes well beyond these limits. This ‘standard’ is simply unconstitutional. I ask the court to abolish it. “

OSHA gives employers with more than 100 employees a January 4 deadline to meet President Biden’s COVID-19 vaccine mandate and threatens thousands of dollars in fines for defiant companies, according to a bulletin published by the White House on Thursday .
The White House has honored the mandate despite opposition from several Republican-led states, arguing that the move is more of a workplace standard than a mandate.
White House Deputy Press Secretary Karine Jean-Pierre responded to a question at a press conference Friday on whether she is confident the mandate will stand up to legal challenges.

“We are very confident that this is possible,” said Jean-Pierre. “On the legal side of this, let me be crystal clear to avoid the seemingly possible misinformation or disinformation about the temporary emergency standard being a vaccine mandate. That would be wrong at first glance, as it has been explicitly said for months, a standard for a safe workplace that either meets weekly tests or requires vaccination. “
Paxton spoke to Fox News Digital after the decision and said he was “very pleased”.

“It’s not the end of the fight, but I’m happy because it gives people hope that they won’t lose their jobs and that the president won’t be able to ruin people’s careers and make their lives difficult.” said Paxton.
Paxton added that he believes the Biden administration will appeal the decision.
“BREAKING: The federal appeals court has just suspended Biden’s vaccine mandate,” tweeted Texas Governor Greg Abbott. “Emergency hearings will be held soon. We’ll have our day in court to stop Biden’s unconstitutional abuse of office. “
